GENERAL TERMS AND CONDITIONS OF THE VINAŘSTVÍ KRIST E-SHOP
1. Introductory Provisions
1.1. These General Terms and Conditions (hereinafter referred to as the “Terms and Conditions”) govern the rights and obligations between Vinařství Krist s.r.o., Company ID No.: 03620654, VAT ID No.: CZ03620654, with its registered office at Zámecká 123, 696 05 Milotice, registered in the Commercial Register maintained by the Regional Court in Brno, Section C, Insert 85918 (hereinafter referred to as the “Seller”), and the customer when purchasing goods through the online store operated at https://www.vinarstvikrist.cz (hereinafter referred to as the “E-shop”).
1.2. The managing director of the company is Tomáš Krist, who is authorized to act independently on behalf of the company.

Website: https://www.vinarstvikrist.cz1.4. These Terms and Conditions apply to the purchase of goods through the E-shop, in particular wine and related products offered by the Seller.
1.5. Legal relationships not governed by these Terms and Conditions shall be governed by the laws of the Czech Republic, in particular the Civil Code and the Consumer Protection Act.
2. Customer Account and Registration
2.1. The customer may purchase goods through the E-shop without registration or may create a customer account.
2.2. When registering, the customer is required to provide true and complete information and to update such information in the event of any changes.
2.3. The customer is obliged to protect the login details for their customer account from being disclosed to third parties.
2.4. The Seller may cancel a customer account, in particular if the customer has not used it for an extended period or has breached their obligations.
2.5. The customer acknowledges that the customer account may not be available continuously, particularly due to maintenance or technical interventions.
3. Sale of Alcoholic Beverages
3.1. The Seller sells alcoholic beverages only to persons who have reached the age of 18.
3.2. The customer confirms that they are over 18 years of age or that the person authorized to receive the order meets the statutory age requirement.
3.3. The Seller is entitled to request proof of the customer's age or the age of the person receiving the shipment before handing over the order.
3.4. If it is not possible to verify that the person receiving the shipment is at least 18 years old, the delivery of alcoholic beverages may be refused.
3.5. If the customer refuses age verification or if the customer's age cannot be verified, the order may be considered undelivered.
3.6. The customer may not order alcoholic beverages for the purpose of resale unless they hold the relevant authorization and unless otherwise agreed with the Seller.
4. Order and Conclusion of the Purchase Contract
4.1. The offer of goods displayed in the E-shop is for information purposes only.
4.2. The customer places an order through the E-shop's ordering system operated on the Shoptet platform.
4.3. Before submitting the order, the customer has the opportunity to review and correct the information entered.
4.4. By submitting the order, the customer confirms that they have read these Terms and Conditions and agree to them.
4.5. By submitting the order, the customer places a binding order for the goods.
4.6. After submitting the order, the customer will receive confirmation of receipt of the order at the e-mail address provided.
4.7. The purchase contract is concluded at the moment the Seller confirms the order.
4.8. If an obvious error occurs in the price or description of the goods as a result of a technical error, the Seller is entitled to inform the customer of this fact and propose further action.
5. Price of Goods
5.1. The current price of each individual product is stated directly with the product in the E-shop.
5.2. Prices include VAT.
5.3. The price of delivery and any additional charges are not included in the price of the goods unless otherwise stated for a specific offer.
5.4. The total price of the order, including delivery and any additional costs, is displayed to the customer before the order is submitted.
5.5. The price stated in the confirmed order is binding.
6. Payment Terms
6.1. The customer may choose from the payment methods available in the E-shop.
6.2. The E-shop currently offers, in particular:
- online payment through Shoptet Pay,
- cash on delivery,
- cash payment upon personal collection.
6.3. When paying online through Shoptet Pay, the customer is redirected to the secure payment interface of the payment service provider.
6.4. When paying cash on delivery, the customer shall pay the price of the order upon receipt of the shipment using the payment method permitted by the particular carrier.
6.5. Cash payment is possible only upon personal collection at the Seller's premises at:

Czech Republic7. Delivery and Shipment of Goods
7.1. The Seller arranges delivery of orders through contracted transport partners.
7.2. The following carriers may currently be used in particular:
- Messenger
- DHL
- LHD Logistic – for pallet shipments only
7.3. The specific delivery method is offered to the customer during the ordering process according to the nature and size of the order.
7.4. The delivery price may vary depending on the number of bottles, weight, dimensions of the shipment, packaging method and selected carrier.
7.5. The current delivery price is displayed to the customer before completing the order.
7.6. The expected dispatch time is generally [TO BE COMPLETED] business days, unless otherwise stated for a specific product.
7.7. For pallet orders, the delivery date may be agreed individually.
8. Personal Collection
8.1. The customer may choose personal collection of the order.

Czech Republic8.3. Personal collection is available during the following hours:
Monday–Friday: 08:00–14:00
unless otherwise agreed with the customer.
8.4. The customer will be informed by e-mail or other appropriate means when the order is ready for collection.
8.5. Proof of age of 18+ may be required when collecting alcoholic beverages.
8.6. Upon personal collection, the order may be paid in cash if this payment option has been selected in the order.
9. Transfer of Ownership and Risk of Damage
9.1. Ownership of the goods passes to the customer upon receipt of the goods, unless otherwise provided by applicable law or agreed between the parties.
9.2. The risk of damage to the goods passes to the customer upon receipt of the goods in accordance with applicable law.
10. Withdrawal from the Contract
10.1. Under the conditions stipulated by the Civil Code, a consumer has the right to withdraw from a contract concluded through the E-shop without giving any reason within 14 days.
10.2. The withdrawal period begins to run in accordance with the Civil Code.
10.3. The customer may use the model withdrawal form published on the E-shop. Use of the form is not mandatory.

Czech Republic10.5. The consumer is obliged to return the goods without undue delay, no later than within the period stipulated by the Civil Code.
10.6. The consumer bears the costs associated with returning the goods unless otherwise provided by applicable law.
10.7. The Seller shall refund the consumer the funds received to the extent stipulated by the Civil Code.
10.8. The right to withdraw from the contract does not apply in the cases specified in Section 1837 of the Civil Code.
11. Complaints and Rights Arising from Defective Performance
11.1. The Seller is responsible for ensuring that the goods are free from defects upon receipt and correspond to the purchase contract to the extent required by applicable law.

11.4. Consumer complaints will be handled within the statutory period.
12. Personal Data Protection
12.1. The processing of personal data is governed by separate Personal Data Processing Policy, which is published on the E-shop.
13. Out-of-Court Resolution of Consumer Disputes
13.1. A consumer has the right to seek out-of-court resolution of a consumer dispute.
13.2. The competent body for out-of-court resolution of consumer disputes is the Czech Trade Inspection Authority, to the extent provided by applicable law.

14.1. These Terms and Conditions are effective from 1 September 2026.
14.2. The Seller may reasonably amend or supplement these Terms and Conditions.
14.3. For a specific purchase contract, the version of the Terms and Conditions effective at the time the contract is concluded shall prevail.
